By accessing and using CellarSpeak (the "Service"), you accept and agree to be bound by these Terms of Use. These terms are governed by the laws of Australia and the courts of Australia shall have exclusive jurisdiction.

2. Description of Service

CellarSpeak is a winery management application that provides voice command functionality, analytics, and inventory management tools for winery operations in Australia and internationally.

3. User Accounts and Registration

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. You must be at least 18 years old to use this service.

4. Acceptable Use and Australian Law

You agree not to use the Service to:

• Violate any applicable Australian laws or regulations, including but not limited to the Privacy Act 1988 (Cth), Australian Consumer Law, and the Competition and Consumer Act 2010 (Cth)
• Infringe upon the intellectual property rights of others
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use the service for any illegal or fraudulent activities

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Please review our Privacy Policy, which also governs the site and informs users of our data collection practices.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, subject to Australian consumer law protections.

8. Limitation of Liability and Australian Consumer Law

Our liability is limited to the maximum extent permitted by Australian law. Nothing in these terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or other applicable laws that cannot be excluded, restricted or modified.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
